Progress March
Street Lighting:
Masa have stated that a new power station is being built by Iberdrola to serve Camposol and surrounding areas.
March update: No further progress, this issue was raised again at a Masa Meeting on Wednesday 5th March, it seems that the power station promised is taking longer than expected.
Subsidence D7:
MASA have presented a schedule of work to the committee documenting the nature of the work to be undertaken agreed with the property owners affected. It is expected that work as scheduled will be completed by the end of March.
March Update: Work is progressing well as per the original work schedule put into place in October. Residents are reporting that they are more than happy with the progress.
At the latest meeting with Masa it was stated that they will re-house the owners of the worst affected property. The Committee welcomed this decision.
There is still one outstanding property, which has been badly affected, Masa has agreed to address this with some urgency.
Masa have now completed an inspection of the a property on C14 and have informed the CRA that they will now meet with the owner to discuss the outcome.
Alternative Access to Camposol:
Access into Camposol and exit to the new motorway - concerns have been raised that the road shown on published motorway plans to take traffic ‘off’ of Camposol has been omitted.
Currently ‘off’ traffic is being routed in front of B Sector Commercial Centre, no explanation of why this has happened has been forthcoming and nothing has been published of any future alternative plans.
Illegal parking on the road in front of the B Sector Commercial Centre is also a cause for concern.
A letter asking for advice, on re-visiting access and exit routes, has been delivered to the Town Hall for the attention of the Mayor.
March update: This subject still remains on the Agenda for all meetings with Masa and will also be on the agenda for the next meeting with the Mayor (to date the CRA have not received any acknowledgement to the letter sent to the Mayor asking for advice and guidance on this subject)
The C.R.A Lawyer, Joaquin Ataz Ruiz, is to present a copy of the original published road plan to the Director of Roads in an attempt to try and resolve the situation.
The ‘No Entry’ sign placed on the exit road from B sector to the new road system is being ignored by many motorists who are using it as a short cut – Please be informed this road is designated ‘One Way’ out of not into Camposol.
Traffico Police have been seen stopping motorists who are ignoring this ‘No Entry’ sign – You have been WARNED!
Turistico Properties
An article was placed in the Costa Almeria News on Friday 14th September which included a statement from the Mayor of Mazarron, as follows:
When asked about the possibility of reclassifying the affected properties. Sr. Blaya said it would be practically impossible to do. Sr Blaya said: “Spanish law stipulates that in any urbanisation certain percentages of constructions have to be given over to specific uses. I can’t change the law.” A lawyer contacted by the newspaper confirmed Sr. Blaya’s comments saying, that the reclassification of the houses would be “extremely difficult to do” and the council was under no obligation to do so.
The CRA Lawyer Joaquin Ataz Ruiz, (who specialises in Spanish Planning Laws) has been tasked, by the CRA, with conducting the necessary research required to prove that this is merely down to a change in the law. In his opinion this is simply a political decision that can be taken by the Mayor and the Mazarron Town Council who only have to have the will to do so. Additionally due to the timing of the said law (regulated by the Decree 75/2005 of the region of Murcia) and it’s implementation within Camposol the council is obliged to do so.
March update: the CRA have received a copy of a letter, in Spanish, sent from the Town Hall relating to this subject. This letter has been sent to our Lawyers for interpretation and advice. As soon as the details are to hand the CRA will advise owners of the details.
Post Boxes
It appears that confusion has arisen between Masa and the Town Hall reference the requirements put forward to each party by the CRA. The Town Hall has asked for clarification as to whether the requirement are for one building to house post boxes for ALL sectors (B,C,D) or a separate building for each one.
The Committee stated that the original request put forward to both parties by the CRA asked for separate buildings to be provided, one for each sector, similar to that which has been provided for sector A .
It was also stressed, that ANY postal system supplied must be the responsibility of and the service provided officially by the Correos from a purpose built office situated on Camposol.
The Town Hall asked for the CRA to submit this request in writing in order to clear up any confusion. The CRA committee have submitted this to the Town Hall and Masa for their considration.
March update:
Councillor Jacqueline Galvez has replied to the above letter informing the C.R.A that a piece of land has been designated adjacent to Sector B Commercial Centre to house Post Boxes, it was not clear however where exactly this land is. Councillor Galvez also intimated that it would be the responsibility of residents to service this building and distribute the post. The C.R.A Committee have since replied to this letter, as in our previous letter, re-iterating that any services regarding the distribution of post is entirely the responsibility of the Correos.
It has recently come to our attention that the Correos are to open an office on Sector B Commercial Centre however, at the time of writing we have not been informed of a date for opening.

14th March Progress synopsis CRA
Camposol – The Story So Far….
The current Liaison Committee of the Camposol Residents Association (C.R.A.) were formed 19th July 2006, after a democratic and transparent election. Regrettably committee members, from time to time, have had to stand down due to changes in circumstances.
Consequently and according to our Articles of Registration it has been necessary to co-opt volunteers onto the committee this was due to the lack of initial nominees who put themselves forward for the July 2006 elections.
More recently, because of the additional workload, the committee voted to recruit a Sub Committee to take on the responsibility for raising much needed funds through social activities.
This is proving to be very successful and we are indebted to these people for their commitment and enthusiasm.
The Committee’ activities of 207 were reported in our January edition of the New Camposol Courier. We trust that readers and the members of the C.R.A. appreciate the extent of the challenges we are facing in Camposol.
The Liaison Committee declared its’ manifesto as a supplement in the November 2006 edition of the New Camposol Courier. We labelled it ‘A Statement of Intent’, this was also re-stated in the February 2008 edition of the New Camposol Courier,
It should be noted that nothing has changed from the November 06 statement.
The ‘subsidence’ problem and the issue of ‘turistico’ revealed themselves post the November 06 statement these could not be ignored and had to be dealt with.
‘We still remain true to our original Statement of Intent’
Thanks to the efforts of our Lawyer we secured our first meeting with Masa on the 17th March 2007. These meetings have continued on a twice monthly basis except during Fiestas. Our meetings, with few exceptions, have been conducted with Daniel Bascunana who holds Power of Attorney for the Masa family. With the exception of the families who live in Florida, so we are informed, we could not in fact communicate at any higher a level.
Progress is slow and we do appreciate peoples’ frustration. However, we request that everyone should please be patient.
The C.R.A. Liaison Committee have been somewhat restrained in our way forward due to the amount of time it has taken to produce the ‘Lawyers Report’ in both Spanish and English. It has always been our intention to use the ‘Report’ as a negotiating tool with both Masa and the Authorities.
When an Association such as ours has the benefit of a fully researched and authoritative interpretation of Urbanization Law, by Spain’s biggest law firm Garrigues – who were voted ‘Iberian Law Firm of the Year’ (Chambers Global Awards 2007) then we should use it as a ‘Vanguard ‘ in our fight for that which we have paid for and expect.
We presented ourselves to the Mayor of Mazarron, Snr. Blaya Blaya, at a meeting on 13th September 2006. The result of that meeting left both the Mayor and Councillor Galvez prejudiced against the C.R.A., which could have been due to the aggressive nature of the issues we presented.
Our second meeting with Snr. Blaya Blaya was on 30th April 2007, this meting was also attended by our Lawyer Joaquin Ataz Ruiz. Bridges were built and an assurance was given to the Mayor and Councillor Galvez that we were not hostile, nor did we seek confrontation, we were only interested in solutions. That meeting finished on a harmonious note with assurances, being made by the Mayor, that he would set about resolving some of our problems.
Our next meeting with the Mayor was on 11th July 2007. The meeting, due to holidays, was attended only by the C.R.A. Chairman and the Press Officer. The Mayor and Councillor Galvez were notified of a 7 item agenda. No satisfactory solutions were offered and as a result we felt the meeting was a waste of time. This was further exacerbated by the Mayor presenting to us the post box keys for Sector B. These keys, to this day, remain useless as Sector B still has no Calle signs and the post boxes provided are unsafe and insecure.
Our Lawyer requested of the Mayor that the C.R.A. be legally registered as an Association having representation within Camposol. The Association has a legal C.I.F. number, which is always printed in the header of the New Camposol Courier, incidentally to obtain this C.I.F t was necessary to adopt ‘Articles of Association’. However, the Mayor stated that “We, the Council do not keep a register of recognised organisations”. It has to be said they are one of the very few throughout Spain no to do so.
Many of the objectives stated in our ‘Statement of Intent’ demand land on which various buildings will house public and social services.
At the time of writing the only land identified is that next to Marianos on Sector A, on which, we are told construction of the Medical Centre will start shortly. It follows that we will never have and of the following without land:

COMMUNITY CENTRE
SECURE POST ROOMS on Sectors B, C and D
and in the fullness of time:
POLICE STATION
SCHOOL
BOWLING GREEN
RECREATIONAL AREAS
If to the above you add the lack of:
DISPENSING PHARMACIA
CORREOS
CAMPOSOL BUS SERVICE
BUS SHELTERS
Then you begin to appreciate the size of the challenges.
Most, if not all, of the above is achievable. For instance, we can report that if a suitable piece of land was identified for a Community Centre, then we have at least two banks willing to sponsor the building. It remains a mystery why an urbanization as big as Camposol has no land provision for public and social services.
On the matter of lack of street lighting we can report that two surveys have been carried out by the C.R.A. to establish, at a point in time, the real situation.
The first, completed in May’07 was handed to Daniel Bascunana.
The second, completed at the request of the Mayor, was registered at the Town Hall in September ’07.
This issue has been raised in no less than seven meetings with Masa, and twice with the Mayor.
The reasons (excuses) given to us for the lack of lighting range from:
If all the lights on Camposol were switched on then the sub-station would fail.
someone, unauthorised, has been seen removing the fuses from control boxes.
Masa is only responsible for the perimeter lights of a Poligono.
Until Camposol is adopted, Sector by Sector, the Council is not responsible. (which is, strictly speaking, accurate)
We have always linked street lighting to the question of security and a promise that in the event of a serious incident, we would hold both Masa and the Town Hall responsible.
With regard to generator supplied electricity, we have raised this question with Masa on no less than five occasions giving specific details of those affected by regular power cuts.
The reasons for the failures (excuses) given:
People have been seen siphoning off diesel from the generators.
The cost incurred in running generators.
Unaware of the problem.
To this end we attempted to secure an emergency telephone number in the event that the customer service office is closed. We were told no such number exists. (see minutes of meeting with Masa 12th December ’07 item 4)
4. We were also told that all houses would be on metered mains supply by
Christmas (which Christmas was not specified).
Now, to the ‘turistico’ problem. Garrigues have always claimed that legally the ruling can be changed if the ‘Political Will’ exists. This means that the Mayor and his council must adopt the necessary procedures to make this happen. Garrigues are currently creating the case to change the ruling.
Abril 28 Licences – Details of 81 works were submitted to Masa, through Daniel Bascunana on 5th June 07. At two subsequent meetings we have requested an update to no avail. The reason given was that these matters have to be discussed with the Mayor as it is the Council who issues the licences not Masa. At the time of writing we are not aware that such a discussion has taken place.
On the subsidence front we have secured a work schedule on some 14 villas. The original number reported to us was 22, however 8 of the owners have chosen to pursue their problems independently through Lawyers of their own, which is their choice and we respect their decision.
Some of those scheduled have had work completed, others have yet to be started. (More owners have reported problems, these too have been passed on to Masa and an updated work schedule is pending ) This issue is always on the agenda of every meeting with Masa.
The matter of (8) ‘missing’ Escrituras (on B4) has been raised on two occasions. Of all the issues this is the most complicated, due in the main to the fact that Masa does not own all the building land on Camposol. Masa have admitted their mistake and given assurances that they will resolve the problem.
Re ‘Certificates of Habitation’ As we understand the situation, the Council should issue these certificates for each villa. This would mean your villa had been inspected by a qualified professional who then stated that the property is fit for habitation. This would then be followed by the Escritura and supply of electricity and water. For some who have their Escritura, we suspect that it states that your villa is ‘under construction’ The implications of the ‘situation in reverse’ we have here, we trust will be solved through the Garrigues Report.
The C.R.A. Liaison Committee firmly believes that Camposol will be a more desirable place to live if we can secure all objectives in our ‘Statement of Intent’ We require that all aspects of Camposol are fully legal and comply with Spanish and European Law. If we can achieve these goals of the C.R.A. To our detractors we an only reply; ‘doing nothing and saying nothing, has got us nothing’ in over 10 years.
Finally, we are at the beginning of our challenge to secure the social and public services we are entitled to by Spanish and European Law. We need help from everyone, through your support of our fund raising activities, the proceeds of which all go to the ‘Lawyers Fund’.

The meeting began at 3pm
Item 1, Request for update on Cibeles 2283 D20.
Señor Ferrer reported that he is dealing with this and would be seeing the
owner later.
Item 2. D2144 D7
We pointed out that this is the one remaining house on the first Work Schedule
which appears to have not yet been dealt with, there being no notes in the
“remarks”column, and asked why not.
Señor Ferrer said that provided that the owners are not using their own lawyer
Masa will carry on there.
Item 3. No Escrituras
We reported 5 properties whose owners have been to the Notary and paid for
their Escrituras at various dates in the previous 18 months but have not yet received
them, and passed on a query from an owner on D15 who has had his Escritura for
some time but his ownership of his house is not yet recorded at the Land Registry.
Daniel is to find out what has happened to the missing Escrituras and hopes to
have an answer in time for the meeting next week.
The time it takes the Land Registry to update their records is not something that
he or Masa can do anything about.
Item 4. No complaints forms in Masa's on-site Customer Service Office.
Daniel said he will find out why there are none available and get some in
there.
Item 5. Generator on D32 keeps running out of fuel.
Roy told Daniel that since this item had been put on the agenda, he had been
inundated with phone calls on Monday of this week about the fact that Miguel had
spoken to everyone he found at home that day in the Poligonos where power is
generator supplied, and demanded that they pay €100 immediately, give their Bank
details, and agree to pay €100 every month for water and electricity or they would be
cut off. He went on to say that people have no objection to paying for these services,
but they feel the amount demanded is excessive and they did object to the manner in
which Miguel demanded the money. He asked Daniel for an explanation.
Daniel's reply was that he could not comment on Miguel's attitude, and that it
must be realised that supplying power through generators is very expensive.
When asked how long this would be going on, Daniel's reply was that he
believed it would only be a couple of months before the meters were fitted and mains
supplied electricity become available.
(Readers should bear in mind that this is a report of the events of the 5th. More has
been reported to us since, and this matter will be raised again at the next meeting)
Item 6. Fuses removed from street lights on D34
Roy told Daniel that a resident had been to the CRA desk and reported that he
had watched a man – not known whether he was a Masa employee or from Iberdrola
– had gone through D34 taking what was thought to be the fuse from each of the
street lights leaving yet another section in the dark, and asked Daniel what he knew
about it.
His answer was “Nothing. He had heard of no such plan and had no idea as to
why it was done”. He will make enquiries at Alicante and let us know what he finds
out at the next meeting.
Item 7. Report on Fortuna 1814.
We asked for news on the awaited architect's report on this property.
Señor Ferrer noted this and will look into it.
Item 8. Fortuna 2143 D7.
Roy informed Daniel that the owner, Mr. Muncaster, is not among the owners
who are acting through a lawyer, and that this property should be included in Masa's
next Work Schedule.
Information was noted to be dealt with.
Item 9. No street lights for 2 years on B20
Following a resident's query at the desk, Roy asked whether Daniel could
explain why.
He could give no reason.
