Masa release new advice on Touristico situation on Camposol.
Masa have sent a letter to the residents of Camposol through Mercers, an estate agent on the site. In it, they talk about the designated “Touristico apartments” which have been the subject of controversy since it came to light earlier this year that owners of the above bought the properties in good faith as “residential”.
According to the law, they say, it is the land which is designated, not the properties, thus, the designation can be changed. They state that ONLY if the owners choose to let their property will they have to comply with the regulations governing Touristico properties, and that the law does not prohibit free transfer of the properties whether residential or not.
“ …there are no legal foundations to argue that the properties cannot be transferred or occupied as a permanent residence…”
This confirms the assertion of Garrigues Lawyer, that the designation can be changed at local level by the mayor, and refutes the advice which has been given elsewhere to sue Masa. This would clearly involve completely unnecessary expense for the complainant.
Therefore, the advice given by the CRA is to use the proforma which they have produced, this being the most appropriate and potentially successful action available to people on Camposol if they want a free and necessary solution to this problem.
