31st Jan Lawyers report due in March.

The CRA met with lawyers last Thursday 25th January. Garrigues have stated that they will have a full report ready in English by March 10th, at which point a date will be set for a public meeting to present their findings to the people of Camposol. We expect to be able to publish the relevant areas of the original proposal on our Legal Assistance page before the end of this week.
We respectfully remind people that we have to have funds to pay for the services of these lawyers, and urge you to contribute if you can. The details have already been published but just to remind people, you can pay cash either directly into the Bankinter on B sector commercial centre between 8-30 and 2-00 Monday-Friday, or to a member of the committee in the post room at Kennelly's on Tuesdays and Fridays between 4-5pm. ESCRITURA AND HOLIDAY HOMES.

28th January.

It has come to the attention of the CRA that a number of properties on Camposol have been designated holiday homes by Mazarron Council. This came to light last week when a number (14) of home owners from sector D went to the notary to collect their escritura. On arrival, they were taken outside by Jaqueline Galvez, acting on behalf of her company, who told them that due to the Council's designation of their homes, they would have to vacate them for one month per year. Their homes would need to be let out for at least one month in twelve.

Ciudadanos Europeneos (formerly Institute of Foreign Property Owners) has confirmed, in writing to this newspaper that this is indeed the law regarding holiday homes; if promoters did not inform buyers of this, and have proof of the same, the promoters may be liable for compensation.

At present, the CRA is aware of homes on three polygonos on sector D which have this designation. They are D24,D29 and D15, we do not know whether it is every house, nor indeed if any other polygonos are affected. If you are concerned, we suggest you consult your solicitor, and contact the CRA directly or, via the courier if you wish.

The CRA is very concerned, and is investigating to ascertain firstly, how many properties are affected, and secondly, what remedies are available for those affected by it. Although the CRA is not empowered to take up individual cases, this situation warrants our support, attention and intervention.

At this stage we are still investigating the extent of the problem, starting with what flexibility the Local Authority is willing to excercise in dealing with the relevant building law, and why the first homeowners heard of this was on the steps of the notary's office. We will keep you updated.

There will be a meeting of the CRA committee on Saturday 13th January. By that time, it is expected that we will have received a preliminary report from Garrigues.

A Public Meeting is planned, which will be open to ALL, and a representative from Garrigues will attend. The details will be posted here on Hot News, and on our Legal Assistance page, provided it is up and running. Of course it will also be posted on the notice boards ( or at least the ones that have not been removed ) as soon as we can confirm the date, time and venue.
